What is the Assistance Benefit

The Assistance Benefit (or Continuous Cash Benefit – BPC ) is the benefit paid by social security that aims to guarantee a monthly minimum wage for people who do not have the means to provide for their own subsistence or to have it provided for by their family. It can be sub-divided into Elderly Assistance Benefit, granted to seniors over the age of 65 and into the Assistance Benefit for Persons with Disabilities, intended for people with disabilities who are unable to participate and enter into parity of conditions with the rest of the society.

The Assistance Benefit is a constitutional guarantee of the citizen, present in art. 203, item V of the Federal Constitution, being regulated by Law 8.742/93 (Organic Law of Social Assistance – LOAS ).

Many people call this benefit LOAS. This is a misnomer, although it is extremely common, as LOAS is the Law that gives rise to the benefit.
